Misdemeanor Attorney in College Station
Brazos County Criminal Defense Backed by Four Decades of Local Courtroom Experience
A misdemeanor charge may carry a lighter label than a felony, but the consequences are real. A conviction creates a permanent criminal record that can affect employment, housing, professional licenses, and educational opportunities. For College Station residents and students at Texas A&M or Blinn College, the stakes are especially high. Whether you’re facing a first-offense DWI, a drug possession charge, or an assault allegation, acting quickly with the right legal team matters.
James, Reynolds, Ask & Kleinschmidt has defended clients in Bryan and College Station since 1983. Our team holds over 90 years of combined criminal defense experience. Three of our partners are Board-Certified Criminal Law Specialists, a credential awarded by the Texas Board of Legal Specialization to attorneys who demonstrate advanced knowledge and courtroom performance in the field. Three are former Brazos County prosecutors, and one associate is a former police detective. That combination of credentials, local courtroom relationships, and insider knowledge of how charges are built and prosecuted isn’t available from a solo practice or a general-practice firm.
We offer free consultations, represent clients without judgment, and provide services in both English and Spanish.
If you or a student in your family is facing a misdemeanor charge in Brazos County, call James, Reynolds, Ask & Kleinschmidt at (979) 227-3305 to schedule your free consultation.
What the Prosecution Sees and What We Do with That Knowledge
Three of our partners spent years as Brazos County prosecutors before joining the defense side. That experience means we know how misdemeanor cases are assigned, how evidence is reviewed, and where prosecutorial decisions get made. We don’t guess at the other side’s strategy. We’ve been there.
Founding partner James W. James III previously served as the first assistant district attorney of Galveston County, managing high-profile criminal cases before building the firm that has served this community for over four decades. One of our associates spent years as a police detective, giving our team direct insight into how law enforcement gathers evidence, writes reports, and builds cases from the ground up. When we investigate a case, we know what to look for because we’ve worked both sides of it.
Texas Misdemeanor Classes: What College Station Clients Are Facing
Texas law divides misdemeanors into three classes under the Texas Penal Code, each with a defined penalty range.
Class A Misdemeanors
The most serious category, carrying up to one year in county jail and a fine of up to $4,000. Charges at this level include assault causing bodily injury, burglary of a vehicle, and DWI with a blood alcohol concentration of 0.15 or higher.
Class B Misdemeanors
Punishable by up to 180 days in county jail and a fine up to $2,000. First-offense DWI and possession of two ounces or less of marijuana fall here, charges that appear frequently in the College Station area, particularly among college-age residents. Prior convictions can enhance a charge and increase penalty exposure.
Class C Misdemeanors
No jail time, but fines up to $500. Public intoxication and minor traffic offenses are typical examples, handled in the College Station Municipal Court and Justice of the Peace Precinct 3. Even at this level, a Class C misdemeanor produces a permanent criminal record unless later expunged.
Class A and Class B misdemeanors are prosecuted in the Brazos County Courts at Law, where jury trials are held weekly. Local knowledge of how those courts operate, and who operates them, shapes every decision in a misdemeanor case.
